AGREEMENT

Welcome to the TheBrand.org.uk  (hereinafter ) "The Company" .TheBrand is a trading name of Lomondhills Ltd. Registered \Limited Company. Registered  Company Number  SC314956
By using this Site, you agree to be bound by, and to comply with, these terms and conditions ("Terms and Conditions"). You also agree to comply with any guidelines or rules posted on the Site regarding any product or service offered on the Site. All such guidelines and rules posted are hereby incorporated by reference into these Terms and Conditions. Please read them carefully. If you are dissatisfied with the Site, its content or Terms or Conditions, you agree that your sole and exclusive remedy is to discontinue using this Site. PLEASE NOTE: We reserve the right, at our sole discretion, to change, modify or otherwise alter these Terms and Conditions at any time. Unless otherwise indicated, amendments will become effective immediately. Please review these Terms and Conditions periodically. Your continued use of the Site following the posting of changes and/or modifications will constitute your acceptance of the revised Terms and Conditions.

COMMUNICATIONS

When you visit TheBrand.org.uk  purchase products or services through the Site, or email the Company, you are communicating with us electronically. You consent to receiving communications from us electronically. We will communicate with you via email or by posting notices on and updates to the Site. By using the Site, you hereby agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. We welcome your feedback about the Site. However, any comments, ideas, notes, messages, suggestions or other communications sent to the Site shall be and remain the exclusive property of the Company, and we may use all such communications in any manner, including reproducing, disclosing and publishing such communications, all without compensation to you.

CONFIRMING, CANCELLING, AND CHANGING YOUR ORDERS

For orders that have already been shipped, you can confirm the date and method of shipment, and obtain an estimated date of arrival by calling our Customer Care Centre at 01382 228509  As long as your order or merchandise from Company has not yet entered the shipping process, you can change the details by calling the Customer Care Centre. Company will not provide reimbursement for shipping and handling charges once the order has entered the shipping process.

ORDER AND PAYMENT TERMS You agree that your placement of any order on the Site is sufficient to satisfy the Statute of Frauds, and no further writing is required. Terms of payment are within Company's sole discretion, and unless otherwise agreed in writing, payment must be received by Company prior to acceptance of an order. Company may accept payment via Visa, MasterCard, Paypal (other credit or debit cards may be added or removed at Company's sole discretion).

Orders are not binding until the order is accepted by Company and Company may cancel or limit an order any time after it has been placed in its sole discretion. Company expressly conditions its acceptance of your order on your agreement to these Terms and Conditions, Site Terms and the terms of the membership, as applicable.

SHIPPING

Unless otherwise noted, Company will make best efforts to ship merchandise within 1 to 3 days of the receipt of a properly completed order, but this is only an estimate. Because of this we have a 15 business day waiting period before any product will be resent. You understand that product availability may be limited and particular products may not be available for immediate delivery, even if the product is not identified as "out of stock" on the Site. Company shall not be liable for any loss, damage, cost or expense related to any delay in shipment or delivery. Company may opt to transfer title to any product and risk of loss passes from Company to you upon shipment from Company's facility.

RETURN, REFUNDS, AND EXCHANGED CONDITIONS

If you need to return any product(s) purchased from TheBrand.org.uk  you must FIRST obtain a Return Merchandise Authorization (RMA) number by contacting customer service at 01382 228509 or by online contact form. An RMA# must be requested within 90 days of the order date.

Customer shall return the products to Printer Inks in the original packaging and enveloped in the original bags or boxes whichever is most appropriate, along with the original invoice or a copy of the original invoice. If no invoice is to be had, please include a letter specifying the problem, and including date of purchase, and the invoice number. Also please include your first and last name, and your phone number. This will help us expedite the solution to your problem, and allow us to contact you if there are any problems, or concerns regarding your return.

You will not receive a refund or reshipment if you use over 50% of the product!. Printer Inks will not be responsible for damaged parts if customer does not follow this process. Please retain shipping information including tracking numbers, until your account has been credited by Printer Inks or replacement product is received. Printer Inks cannot be held liable for any lost packages that are not given any type of tracking number or documentation. If Printer Inks determines that failure of the product(s) was not a result of a defect in materials or workmanship, or if the reason for return does not involve failure, then Printer Inks reserves the right to charge the customer for parts and labour at Printer Inks current labour rate, or charge the customer a 20% restocking fee. The Company will advise customer prior to assessing these charges.

If no order number (invoice number) or RMA number is included, there may be a delay in the return process.

If you do not state whether you desire a refund or a replacement, a standard replacement will be issued.

Before a refund and/or reshipment can be issued, cartridges in question must be returned.

Refunds will be issued in the same form as the original payment. If paid by credit card, a credit will be issued to the original credit card provided on that specific order.

COMPONENT RESALE

Customer shall not engage in the business of reselling components purchased from TheBrand, or remove components from product for resale, except upon express prior written authorization of TheBrand.

ASSIGNMENT

Customer may not assign its rights or obligations hereunder without the express prior written consent of TheBrand.

GOVERNING LAW, JURISDICTION AND COSTS

This agreement is governed by the laws of the UNITED KINGDOM, without regard to its conflict or choice of law provisions. Customer acknowledges and agrees that the UNITED KINGDOM is an appropriate place for venue of any litigation and that UNITED KINGDOM courts have jurisdiction over this agreement and customer. In the event the customer and the Company are unable to resolve any customer dispute, and any collection action, suit or other judicial proceeding is commenced, the prevailing party in any such collection action, suit or judicial proceeding shall be entitled to recover its costs and reasonable attorneys fees incurred.

TAXES

Unless otherwise stated on the face hereof, stated prices include all tax and duties.

TERMS OF LIMITED WARRANTY

The Company  warrants to the original customer purchasing such products directly from the Company that all such products sold will be free from defects in materials and workmanship affecting form, fit and function. Any claim alleging that any product fails to conform to the foregoing warranty may be made only by the customer who purchased such product and only while such customer owns such product. The Company, at its option, will repair, replace, or provide a credit or refund of either the original purchase price or fair market value, whichever is lower, that is determined by the Company to be defective. The Company reserves the right to substitute functionally equivalent new or serviceable used parts. The Limited Warranty covers only defects arising under normal use and does not include malfunctions or failures resulting from misuse, abuse, neglect, alteration, problems with electrical power, usage not in accordance with product instructions, acts of nature or improper installation or repairs made by anyone other than the Company.

The Company  MAKES NO WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OTHER THAN THAT The Company WARRANTS THAT SUCH PRODUCTS COMPLY WITH THE APPLICABLE PRODUCT DATA SHEET EFFECTIVE AT THE TIME OF SHIPMENT AS AVAILABLE FROM TheBrand.org.uk  ON ITS WEB PAGE( htt/www.TheBrand.org.uk). Any claim with respect to such products must be made 90 days from the original date of shipment from the Company premises and the Company shall have no liability thereafter. All WARRANTIES cover only defects arising under normal use and do not include malfunctions or failure resulting from misuse, abuse, neglect, alteration, problems with electrical power, usage not in accordance with product instructions, acts of nature or improper installation or repairs made by anyone other than the Company or a Company  authorized third-party service provider. The Company, at its option, will repair, replace, or provide a credit or refund of either the original purchase price or fair market value, whichever is lower, for any product covered by the foregoing warranty that is determined by the Company to be defective. The Company reserves the right to substitute functionally equivalent new or serviceable used parts.

TERMS AND CONDITIONS

This sale is subject to the terms and conditions stated herein, which are in lieu of and replace any and all terms and conditions set forth in any documents issued by customer, including, without limitation, purchase orders and specifications. In case of conflict between the terms and conditions stated here and those on the face hereof, those on the face hereof shall control. ANY ADDITIONAL, DIFFERENT OR CONFLICTING TERMS AND CONDITIONS ON ANY SUCH DOCUMENT ISSUED BY CUSTOMER AT ANY TIME ARE HEREBY OBJECTED TO BY the Company, AND ANY SUCH DOCUMENT SHALL BE WHOLLY INAPPLICABLE TO ANY SALE MADE HEREUNDER AND SHALL NOT BE BINDING IN ANY WAY ON the Company.
